This privacy and cookie policy is effective from 25th May 2018

Gamma Illumination (‘we/us/our’) is committed to ensuring that your privacy and personal data is protected in line with the latest legislation.  By providing your personal information you acknowledge that we may process it in accordance with this privacy policy.

This privacy policy aims to give you information on how Gamma Illumination collects, stores and processes your personal data.  It is important that you read this privacy policy so that you are fully aware of how and why we process your data.

 

Who is collecting the data?

Your data is being processed by Gamma Illumination, the data controller.  We are a designer and manufacturer of low energy lighting solutions.  Gamma Illumination is a division of Martech UK Ltd who is registered in England and Wales CRN:  3045105.  Our registered address is Thornhill Road Industrial Park, Tenter Fields, Dewsbury, West Yorkshire, WF12 9QT.

It is important that the personal data we hold about you is accurate and current.  Please keep us informed if your personal data changes during your relationship with us.

 

What data is being collected?

We may collect, store, use and transfer information that could identify you as an individual and this is referred to as personal data.  This data may include name, job title and other company contact details such as email, address and telephone numbers and we collect this data in line with the latest data protection legislation.

 

How is your personal data collected?

There are a number of ways we may collect information about you.  These include:

  • Direct contact – you may give us your contact information by phone, email, web forms, events or exhibitions and otherwise
  • When you use our website – we may collect technical data about your equipment, browsing actions and patterns.  This personal data is collected by using cookies, for more information on cookies please see the website cookies section.
  • Third parties or publicly available sources – we may receive personal data from third parties or publicly available sources, for example:
    o Online publications

    o Event organiser’s

 

How will your data be used?

We process (collect, use and share) personal data when the law allow us to do so.  We use your personal data for legitimate business purposes, which commonly include:

  • Where we need to perform the contract
  • Where it is necessary for our legitimate interests and your interests and fundamental rights do not override those interests
  • Where we need to comply with a legal or regulatory obligation

GDPR states that ‘processing of personal data for direct marketing purposes, may be regarded as carried out for a legitimate interest’.  We process your personal data for legitimate business interests, as part of this you have the right to object to this type of processing and can do so by emailing info@gamma-uk.com.

When you contact us through the website, your details will be sent to a member of the team, who may create an account for you on our Sage CRM (Customer Relationship Management) System.  In this system we may keep a record of times and dates of when we have spoken, emails, meetings, or information relating to order processing.

We may also occasionally collate data using Microsoft Office applications.  In addition we also use third party email software such as Outlook which may store your email address in its contact book if we email you directly.

When you sign-up to our mailing list, we will also add your email address and name to Campaign Monitor for email marketing purposes.  All emails that you receive using Campaign Monitor will come with a clear link of how you can unsubscribe.

Please note that unsubscribing from our Campaign Monitor list does not unsubscribe you from all communications, or remove you from our CRM system.  To do this, see ‘Your legal rights’ below.

We may also use your contact details to find and connect or follow you on LinkedIn, Twitter and Instagram, if you use these platforms.

 

Who will your data be shared with?

We will not share or sell your data to any third parties for marketing use.

Our employees may see your personal details in their day-to-day work.

We store the majority of our data on our internal servers.

We use third party email software called Campaign Monitor and this may be used to store your data for our email marketing purposes.

 

Data security

We take data security seriously and have put systems in place to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed.  We also limit the access of personal data to our employees and third parties who have a legitimate business need to know.  They will only process your personal data on our instructions and are subject to a duty of confidentiality.

We have put systems and procedures in place to deal with any suspected personal data breach, this includes notifying you and the regulator of a breach where we are legally required to do so.

 

How long do we keep your data for?

We will only keep your personal data for as long as it is necessary for us to carry out the purposes we collected it for, this includes any legal, accounting or reporting requirements.  In relation to personal data we use for direct marketing, we will keep this for as long as we are able to market to you and if you opt-out, we will keep your contact details only to ensure we do not contact you again for marketing purposes.

Your legal rights

Under certain circumstances, you have the following rights under data protection laws in relation to your personal data:

The right of access – you can request to receive a copy of the personal data we hold about you and to check we are lawfully processing it.

The right to rectification – you can have any incomplete or inaccurate data we hold about you corrected.

The right to erasure – where there is good reason, you can ask us to delete or remove personal data.  This includes where you have successfully exercised your right to object to processing, where we may have processed your information unlawfully or where we are required to erase your data to comply with local law.  Please note that we may not always be able to comply with your request of erasure for specific legal reasons which, if applicable, will be communicated to you at the time of your request.

The right to restrict processing – under certain circumstances you can ask us to suspend the processing, but not delete, your personal data.

The right to data portability – you can request the transfer of your data to a third party.  We will provide you, or a third party, your personal data in a structured, commonly used, machine readable format.  This right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

The right to object – where we process your personal data on the grounds of legitimate interest and you feel that the processing impacts on your fundamental rights and freedoms, you have the right to object where we are processing your data for direct marketing purposes.  In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

You will not have to pay a fee to access your personal data or to exercise any other right.  However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive.  Alternatively, we may refuse to comply with your requests in these circumstances.  In the event that you wish to exercise your right, we may need to request specific information to help us confirm your identity.

Should you receive an email from us using the Campaign Monitor email marketing software, you will always see an unsubscribe link in the footer to remove yourself from future mailings.

 

Sharing data with third parties 

With your consent or when considered a legitimate interest, that does not negatively affect your rights and freedoms as an individual, we may also share your data with other third parties.  These third parties and the reason for sharing your data with them is listed below:

We use Google Analytics to collect anonymous information about users’ activity on the Site as well as to monitor and report on the effectiveness of the Site to help us to improve it.   

E-newsletter

We use a third party provider, Campaign Monitor, to deliver our email newsletters.  Our email marketing campaigns may contain personal data which could be stored in a database for future analysis, this information may include, amongst others, information and statistics around opening and clicks.  For more information, please see Campaign Monitors privacy policy.

The information we collect from tracking e-newsletters is used to help us refine our future email campaigns.  We may also use the data to contact you about in relation to the email.

In order to comply with the Privacy and Electronic Communications Regulations 2003 (PECR) all users are given the opportunity to unsubscribe from our e-newsletters at any time by clicking on the link in the footer of each email campaign.

Social Media Platforms

We use external social media platforms to communicate and engage with users of these platforms.  We do so under the terms and conditions as well as the privacy policies published by the individual platforms.

If you direct message us using a social media platform the message will be stored by the platform and will not be shared with any other organisations.

Links to other websites

Our website may contain links to other websites of interest.  However, once you have used these links to leave our site, you should note that we do not have any control over that other website.  Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy policy.  You should exercise caution and look at the privacy policy applicable to the website in question.

We regularly review our privacy policy and may change it from time to time by updating this page.  We will also communicate any changes through our website, however, you should check this page periodically to ensure that you are happy with any changes.
